Thank you for your interest in a position with Bechtle. We understand that your data is a sensitive matter. That’s why all personal information you submit via our application form is exclusively used for the purpose of the application process and we won't contact you for any other reason. No data are transferred to a third party without your consent. With the help of this document, we will inform you how Bechtle processes your personal data and the rights you have.

Categories/origins of data

When you fill in the application form, you are asked to provide certain personal information. All data required to complete the application form is subject to the principles of data reduction and data economy, meaning you only have to provide the data that is absolutely needed to process your application, such as a CV, or that which we are required to obtain under applicable law.

Mandatory information is marked with a * (asterisk). Without this information, we are unable to process your application. It is therefore not possible to upload application documents to the portal without also providing this information. If you wish, you can also provide additional, optional information via the application form.

When you apply for a position in our company, we collect and process the following data:

• Master data (e.g. last name, first name, additional names, academic titles, date of birth),
• Qualifications and education information (e.g. C.V. references),
• Contact details (postal address, phone number, e-mail address),
• Language and IT skills, if required,
• Work permits and residency permits, if required,
• Work permits and residency permits, if required,
• Driving licence, if required.
• Optional: information on how you found the position, when you would be able to start work, regional mobility, desired number of hours and contract duration, any previous positions with Bechtle, and any social commitments.
• Due to technical reasons, we will also process your IP address.

You may also choose to provide information regarding your personal accounts on social networks that may be relevant to your application.

Your personal data is collected directly from you during the application process. In certain, exceptional cases, we also collect your personal data from other sources, such as recruitment agencies.

Additionally, we use personal data permissibly obtained from publicly available directories, such as professional networks.

Purposes and legal bases for data processing

Your personal data is collected and processed in accordance with the provisions of the EU GDPR, the German Federal Data Protection Act (new), and all other (labour) law provisions.

In accordance with Art. 88, Para. 1 EU GDPR in conjunction with Section 26, Para. 1 German Federal Data Protection Act (new), it is permitted to process employee personal data for the purposes of an employment relationship if required for the decision to establish the relationship, or to realise or end the relationship once a decision has been made.

Additionally, permission to process data, including special categories of personal data, can be granted from certain further laws, especially industry-specific (compliance) provisions.

Your consent to the data protection provisions also expresses your consent to data processing. We hereby clarify the purpose of data processing and your right of revocation in accordance with Art. 7, Para. 3 EU GDPR, Art. 88, Para. 1 EU GDPR in conjunction with Section 26, Para. 2 German Federal Data Protection Act (BDSG) (new). If consent also refers to the processing of special categories of personal data, we will expressly point this out to you when obtaining consent, Art. 88 Para. 1 EU GDPR in conjunction with Section. 3 German Federal Data Protection Act (new).

Processing of special categories of personal data according to Art. 9 Para. 1 EU GDPR only takes place if this is required by legal regulations and there is no reason to assume that your legitimate interest in the exclusion of the processing prevails, Art. 88 Para. 1 EU GDPR in conjunction with Section 26 Para. 3 German Federal Data Protection Act (new).

For reasons of application recognition, certain basic candidate data is saved in our system for 365 days (180 days for trainees and dual students). This data consists of names, date of birth, e-mail address and an (internally assigned) applicant number.

Data retention

Your data will be deleted once they are no longer required for the above purposes. We keep your data for the above purposes for the duration of the application process and until all related deadlines have expired; for no longer than six months after we have informed you whether your application has been successful.

We will retain your data beyond this point only if we are entitled to or have an obligation to do so, e.g. if you have given your express consent for us to retain your data for an extended and specified period of time, or to exercise our rights under applicable law. For instance, we are obliged to retain certain data under the German Tax and Commercial Codes. All statutory periods of limitation are observed.

The login credentials for your account on our application portal (which contains at least your full name and e-mail address) are purged after six months.

Your account can be renewed for another six months only if you have given us your express consent to retain your credentials for this extended period. Should your account expire while you still have a pending application, the retention period will be extended until the application process has been completed.

Further to this, we save and process application data for statistical purposes in anonymised form without personal information, making it impossible to infer your person from such data.

Protection of personal information

We have implemented security measures to ensure that your data remain safe and confidential at all times. All application documents submitted via the application portal are encrypted. Provisions to protect your information always correspond to the latest technological standards.

Data recipients / categories of recipients

In our company, we ensure that only departments and people involved in the application process receive your application data. Please be aware that if you simultaneously (directly) apply for multiple positions at Companies within the Group, the relevant HR and specialist departments can come to know of these applications and their statuses.

Rights of the data subject

Your rights as a data subject are set out in Art. 15 - 22 EU GDPR.
These include:

In the event that we process your data to safeguard legitimate interests, you can object to such processing at any time for reasons relating to your particular situation; this also applies to profiling based on these provisions.

We shall no longer process personal data unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.

If we process your personal data for the purposes of direct mailing, you have the right to revoke this without provision of reason. This also applies to profiling in connection with direct mailing. If you object to the processing of your personal data for direct marketing purposes, we will no longer process it for these purposes.

Right of appeal

You have the right to appeal to the data protection supervisory authority.

Intention to transfer data to a third country

Data is only transmitted to third countries (outside the European Union or the European Economic Area) if you have given us your consent or if required to do so by law.

Obligation to provide data

A decision regarding establishment of an employment relationship—on an application’s chances for success—is not possible without provision of certain personal data. Additionally, there are legal rights and obligations that require us to ask for certain data at this stage.

Automated case-by-case decisions

Please be aware that we generally do not use any purely automated processes in reaching our decisions.
